Anyway, you can%26#039;t force them to reduce the debt. All you can do is continue not paying it. As the debt gets older, they will be willing to deal more. Of course, that also will trash your credit more and more.



Whenever you do reach a deal, make sure to get the terms in writing and make sure you and they stick to them.

Let%26#039;s not forget about the hundreds of millions of credit card solicitations that people are bombarded with every month. But lenders often DO dangle credit opportunities in our faces and even to those whose creditworthiness is marginal at best. But the lenders ultimately write off or recoup losses by balancing their books on the backs of their good account holders. This practice raises the cost of doing business for everyone.

Bankruptcy laws are far too lenient, you should not have the option of %26quot;getting out of debt free%26quot; that you created.



Personal responsibility is lacking in this day and age, everyone wants someone else to blame.

At worse they%26#039;ll send bailiffs to get your goods but if you move home then that is about it, this is in the UK.



I think the blacklist only lasts for 5 years then you can re-apply for another credit card from the SAME bank. I know someone that used to work for barclays and did it to them at least three times over some 20 years, he just used the cards normally until they increased the borrowing amount then drove them through the roof and disappeared for some 5 years. i think he did the round of the banks every 5 years for a while, very strange but true.



He also changed his name (legally) a few times and did it some more.



It is not a criminal offence so you don%26#039;t go to jail. This is in the UK and it is as far as I know, so don%26#039;t go about blaming me if something go wrong, I pay my bills and will die poor but honest.

Send a %26quot;debt validation letter%26quot; to these creeps. The statute of limitations has expired years ago and legally they can%26#039;t take you to court or even report it to the credit bureaus. These collection companies will send these letters out on old debts they have purchased trying to see if they will get a response. If they get none after 30 days from the date they mailed it, then they report it to the credit bureaus. Here is a template of a letter you could use:

Ask an attorney. There are firms that allow the first consult free of charge. As for the agency saying they purchased the acct in 06, that means they %26quot;bought%26quot; your debt even though it was inactive in an attempt to get money from you. The interest accrued alone must be immense



DEFINITELY consult a lawyer. But also be aware that someone MAY be trying to steal your identity through your credit card, whether it%26#039;s closed or not. I.D theft online is rampant these days.

be aware, there are some states that say if you ...tell them on the phone or sign a letter say you DO owe the amount then you reactivate the debt. So sign nothing that says you owe the amount. Also, if they call you...tell them you do not want to be called at home, and send this in writing to them.



It against the law for them to do alot of things, that they will try.



The statue of limits on a debt is usually 7 years.



If you make a payment on this debt, a small one, then you can be considered liable for the debt and they will say you accept the debt, and try to make you pay legally.

The credit card company probably sold your account to the collections company. That company can place it back on your credit report and tack on interest for each month your account continues to be deliquent.



In most cases, you can negotiate a settlement and payment plan.



What%26#039;s so crazy is that the credit card company has already charged off this account (tax write-off for them), and raised the interest rate on current customer accounts. So the creditor has already made up for this loss and now a bunch of scavengers (the collection agency) get to make more money off of you. They probably only paid $20 to acquire this account. This is completly legal - it%26#039;s called capitalism.

You may also want to check with the consumers affairs office in your state, just to make sure the collection agency is following fair business practices.

Yes, they can still TRY to collect from you. This is because your debt is being sold repeatedly from one collection agency to another. However, most likely the debt is beyond the statute of limitations, so they would not be able to collect. The easiest way to get rid of them is to reply in writing that you dispute the charge and make them prove it to you. your credit card company would be silly to turn down any money that you send. You can easily send $100-$500 a month until paid off and they will accept it. However, it still may show up on your credit report as a late pay. The lowest they will go is about 50% and that is usually if the account is long over due.....like a year or more.

Please remember that whatever you don%26#039;t pay in the settlement is considered income and you will be taxed for it at year end. Also, please remember that it will show on your credit as %26quot;settled%26quot; not %26quot;paid as agreed%26quot;. Whenever it says anything other than %26quot;paid as agreed%26quot; it is a negative on your credit.

Look for another credit card company. What they offered you is not going to work then shop the market for balance transfers. Look for something with a very low interest rate for balance transfers. Make them work with you on a payment plan.

Sounds like you only have 1 credit card, and no other revolving accounts. Do you have auto loans, student loans, etc? If not, only 1 credit card won%26#039;t be enough credit history to qualify for a mortgage.



Also, 100% financing is now very difficult, and requires good reserves, and full income documentation , as well at least three open lines of credit with 2 year history on each.

Now that they have a court judgement on you, you have few options.



You pay it. That means you need to cut your living expenses and/or find another part time job.



You don%26#039;t pay it. Then they will garnish your wages and repo your property. End result is same as above.



You can file bankruptcy. Without more info on your situation I can%26#039;t begin to recommend this. If it%26#039;s a small judgement, and you have no other bills, that would be a silly way to go.



For now, call the creditor and see what sort of settlement you can get. Be serious about it! Don%26#039;t offer $20 a month on a debt of $5000. There is no way they will wait 20 years to get paid! Many financial advisors suggest that you periodically review your credit report for inaccuracies or omissions. Checking in advance on the accuracy of information in your credit file could speed the credit-granting process, clean credit is a must.



Because businesses use this information to evaluate your applications for credit, insurance, employment, and other purposes allowed by the Fair Credit Reporting Act (FCRA), it%26#039;s important that the information in your report is complete and accurate.



Whenever you apply for any type of credit or financing, a credit report is pulled from at least one of the three major credit bureaus. You want a clean credit report to be pulled. First to get clean credit reports, tell the credit reporting agency in writing what information you believe is inaccurate. Include copies (please keep your originals) of documents that support your position. In addition to providing your complete name and address, your letter should clearly identify each item in your report you dispute, state the facts and explain why you dispute the information, and request deletion or correction. Always keep copies of your dispute letter.



They must reinvestigate the items in question, usually within 30 days, unless they consider your dispute frivolous. They also must forward all relevant data you provide about the dispute to the information provider. After the information provider receives notice of a dispute from the CRA, it must investigate, review all relevant information provided by the CRA, and report the results to the CRA. If the information provider finds the disputed information to be inaccurate, it must notify all nationwide CRAs so they can correct this information in your file. Disputed information that cannot be verified must be deleted from your file, then you will recieve a clean credit report, with that item removed.



If your report contains erroneous information, the CRA must correct it(clean credit).



If an item is incomplete, the CRA must complete it. For example, if your file showed that you were late making payments ( 30 days or more), but failed to show that you were no longer delinquent, the CRA must show that you%26#039;re current.



If your file shows an account that belongs only to another person, the CRA must delete it.



When the reinvestigation is complete, they must give you the written results and a free copy of your clean credit report, if the dispute results in a change. Also, if you request, they must send notices of clean credit report corrections to anyone who received your report in the past six months. Job applicants can have a corrected copy of their clean credit report sent to anyone who received a copy during the past two years for employment purposes. If a reinvestigation does not resolve your dispute, ask the CRA to include your statement of the dispute in your file and in future reports.



Second, in addition to writing to the credit agency, tell the creditor or other information provider in writing that you dispute an item. Again, include copies (please not originals) of documents that support your position. Many providers specify an address for disputes. If the provider then reports the item to any credit reporting angency, it must include a notice of your dispute. In addition, if you are correct that is, if the disputed information is not accurate the information provider may not use it again, thus you will have a clean credit report.



When negative information in your report is accurate, only the passage of time can assure its removal. Accurate negative information can generally stay on your report for 7 years.



Clean Credit: There are certain exceptions:



Bankruptcy information may be reported for 10 years.



Information about criminal convictions may be reported without any time limitation.



Credit information reported in response to an application for a job with a salary of more than $75,000 has no time limit.



Information about a lawsuit or an unpaid judgment against you can be reported for seven years or until the statute of limitations runs out, whichever is longer. Criminal convictions can be reported without any time limit.



Credit information reported because of an application for more than $150,000 worth of credit or life insurance has no time limit.

Your credit file may not reflect all your clean credit accounts. You are correct- debt is something you should try to NEVER have. Some debt is sort of %26quot;necessary%26quot; (in order to get a house you need a mortgage, etc.), but credit card debt is TOTALLY unnecessary!



My advice to you is try to show your husband how bad debt can be. Find out your credit card rate and do some calculations with him to show him that you%26#039;ll waste LOTS of money by only paying off the minimum.



There might even be websites that do the calculations for you (try looking at one of those %26quot;debt consolidation companies%26quot;).



You should also let him know that credit card debt hurts his credit rating, which will hurt his chance of getting a loan in the future. It might hurt yours, too, if you combine accounts (I could be wrong about that, but it%26#039;s something to look into).

If your name is not on the account, no they cannot. It is a pressure tactic to get the account paid by any means possible. Unless the credit card company hires a lawyer to collect, then and only then can they go through garnishment, and you would get a notice in the mail from the lawyer stating that they will garnish your wages and then it is like another 2-4 months before they actually garnish your wages. It is just a scare tactic into getting you to pay.

But you should also know that just by making those threats they are breaking the law. Collectors can not communicate intentions to collect based upon fraudulent or misleading information, they can be sued big time for that. Don%26#039;t do that. Roll the leftover money toward the premium of the home loan. If your lender needed you to pay off the credit card debt, they would have made you do that before lending you any more money. In fact, if you are closing at a title company, you probably will have to pay of any other loans to obtain clear title to the home, and it is doubtful that your lender will actually give you the money. It goes to the title company, or third party closing agent to pay for closing fees, the purchase price, lender fees, etc and you just sign the papers that say how much you owe, and when you will pay it back.



And don%26#039;t spend the extra ahead of time. You may be approved now, but I have been in situations where borrower%26#039;s are approved for $100,000, buy a $90,000 home, go out and buy $10,000 worth of furniture for their new home on credit, and cannot close because now their debt to income ratio is too low and the lender will no longer provide a loan at the previously agreed upon terms (and yes they can do that if there is a significant change in your credit score before closing).

It depends on what type of loan you have been approved for. Just because you have been approved for a certain amount that does not mean you can have cash out. It usually means the price home you have been approved for. The loan will be based on the price of the home and the loan to value. You need to be more specific.

Using the home loan money to pay off credit card debt will be a short term fix. Remember, if you take equity out of your home and cannot pay the loan back they will take your house. Generally the underwriter for your mortgage company frowns upon this, especially for your first loan. Let%26#039;s face it, you havent proven yourself to them yet. The method to attempting this requires that you have equity built into your purchase (ex: your appraisial comes in $20k or more than the purchase price.) If you have this, then you can ask your mortgage broker or company if they would consider consolidating some of your bills into the loan. If the underwriter approves this than they would directly pay off the obligations to the company that you owe. Things to consider when you do this. Will you actually save money on your obligations? How long do you plan on living in this home? What is the market forecast to be in your neighborhood in the next several years? Will the underwriter require you to have a pre-payment penalty if you chose to refinance? If you pay off your bills and roll them into a longer term, staying in your home for ten years, chances are you will probably pay more in interest than you would have if you continued on your current payment plan. If the value of your home isnt projected to go up very much in the next few years, you will hurt the amount of tax free profit you would have made in the event of a sale after two years. Also consider that a pre-payment penalty will cost more out of your pocket than simply paying your normal bills now, in the event you want to refinance. Generally if you were approved for a higher amount than your purchase price, that doesnt mean that you can access that money. Your best bet would be to do 100% financing and reserve your current downpayment to pay off those bills.

Properties are evaluated on the accounting principal of lower of cost or market. In other words, the cost of the property is the most they will loan you, plus closing costs of up to 3% in the case of things like a VA loan. But unless they%26#039;re getting a government guarantee like a VA loan offers, lenders do not like lending more than the purchase price. They don%26#039;t get it back if you default. Even if they will agree to it (without you committing fraud), they will charge you a higher interest rate on the entire loan to compensate.



There are other ways to do it, but most of them involve fraud of one sort or another.



The %26quot;low monthly payment%26quot; is a sucker%26#039;s game unless you really need it, and even then be careful. Here%26#039;s an article I wrote about refinances which are very analogous to what you want to do with your purchase.

A BANK WILL NOT ALLOW THAT TRANSACTION IF THEY KNOW ABOUT IT...



the bank is only going to loan you what the SELLER says the purchase price of the house is... They WILL NOT lend you more then that, it is IMPOSSIBLE!!!!



THE ONLY WAY TO GET AROUND IT IS TO WORK SOMETHING OUT OUTSIDE OF CLOSING!!!!!!



what i mean by that is you reason with the seller to increase the purchase price to whatever you need over what it currently is...



ex: price is $80k..you need an extra $10k....have the seller say the purchase price is $90k....



Here%26#039;s the thing though...when your loan FUNDS the money is transferred to the SELLERS BANK ACCOUNT!!!



you will need to in writing (outside of closing) have the seller sign an agreement with you saying they will give you the extra $10k back after they receive their funds...



Again the bank will not allow it, but if they dont know about it... and they think the price is the $90k, then they will never know....



You have to have a pretty leniant seller, or one that is desperate to get rid of his house to make this happen...

If you don%26#039;t already have one, put together a solid business plan that shows how the company is going to be successful and when it will be turning a profit. Make sure your business plan covers who your customers will be, how you will get them, how much it%26#039;s going to cost to run the business, how much you plan to make, who your competitors are, and how you are different or better than the competition.



Once you have a solid business plan, put together no more than 3 or 4 slides that show what your company is doing and why it is a great investment. Then go out and find investors.



I%26#039;m not sure what kind of %26quot;entertainment%26quot; company it is, but perhaps you could start by calling local television stations, radio stations, party companies, or whatever is most appropriate. While those companies themselves may not want to be investors, there may be people that work there who understand the business and would be willing to invest in you or they could point you to other potential investors.



There may also be VC (venture capital) folks who would be willing to invest.



You could also approach friends and family, although I would recommend against it. Money always seems to be a good way to ruin personal relationships. If you do approach them though, it would be a very good idea to keep it as professional as possible--get a contract and everything else you would as if you were dealing with a non-relative investor.



Another option is to find a company that does something similar to you but which you can do better or more efficiently and see about starting a joint-venture, or about jointly approaching customers. They may not give you money to pay off your debt, but they have the possibility to introduce you to a lot of potential customers and business that could provide enough cash flow to get you going.

If you where unaware of some of the purchases made you may have some recourse againist your business partner. If you are going to use your personal money for anything it better be an attorney. I am not talking about suing or bankruptcy necessarily but you need to know what debt the business is responsible for, what debt you are responsible for, and what debt your former business partner is responsible for. Also an attorney can help you possibly negotiate those debts lower. Take all financial statements with you to the consultation and any contracts you and/or they have signed.
