From a legal standpoint can people go after my assets to collect on my husband's debts?

My husband and I are not together anymore, but are still legally married. He has a lot of past due credit card debt and owes back child support to his ex wife because he hasn%26#039;t been working. We have no joint accounts or assets of any kind, but I want to know if legally I should be worried about people coming after me and my money to collect on his debts? We have two kids which live with me and he is not supporting in anyway, I want to make sure my money in my bank accounts will be safe.

Yes they can. As long as you two are married, half of what you own is considered his. They don%26#039;t have to have both your names on the deed, as the marriage certificate makes the two of you a legal pair, equally obligated to settle any or any debts that acquires during the marriage.

As long as your money is seperate, you should be fine.

Get divorced now! 50-50 laws can cut both ways depending upon the state. You are going to want to file a complete declaration of assets and liabilities to ensure that the court has a record of all the debt that is his so you can not be made responsible. The sooner the better.

In a word--yes. Get divorced, have file for bankruptcy on all joint and previous debts in his name.

Yes, because debtors don%26#039;t care about your situation they only want there money back. Since you two are still legally married they may come after you. As far as the back child support for his other child that you should not worry has nothing to do with you but for the cc debts they can. You may want to seek some legal advise to make sure and check what your options are.

Unless you are in a community property state, you sound like you will not have any problems. Please divorce him as soon as possible and get him to pay child support. You should not have to carry the financial burden alone.

I have sole custody of my kids. My ex-wife is making it extremely difficult for me. She only gets supervised visits. She has made a loan for $5000 after we split up and before I could file for divorce and custody. I did not know anything about this until they started garnishing my wages. $600 a month. She has not paid a penny of child support. She is supposed to pay $200 a month. She gave her boyfriend my SSN and DL and I have been having to clear my name for warrants, tickets, and the like. That cost money to do as well. How much will I have to pay because of her? I don%26#039;t know when it will end. I found out a couple months ago there is another loan she made just before we split and I am having to pay for that as well. All because we were still married at the time, I am responsible for here until the FILE DATE FOR DIVORCE DATE.
